TERMS OF USE
1.Introduction
Present regulations determine the rules of using Afrix.org. and the rights and obligations of its users. By using Afrix.org all user acknowledge that they have read the contents of the Regulations, accept all its provisions, as well as undertake to comply with them.
2.Registrations
Users access the service after prior to registration and setiing up a new profile which is based on filling in the appropriate form located on www.afrix.org. Registration requires the following personal data: name, surname and e-mail address. The profile can also be created by an NGO, institutions, universities and other not- individual users. Users can specify their nickname intead of placing name and surname.
By completing and submitting the registration form the USER:
1.Consent of collecting and processing data by www.afrix.org, placed in the form, so far as it is necessary to use our webpage, in accordance with the Privacy Policy introduced in second part of this Regulation, as well as in accordance with the Act of August 29, 1997 about the Protection of Personal Data. And the Act of 18th July, 2002- the Electronic Service Delivery. The administrator of these data is the foundation ‘ other Africa, based in Warsaw, entered in the National Court Register under number 0000313745, NIP 542-310-27-79, REGON 200, 233, 784- the owner and administrator of an internet platform Afrix.org. The agreement does not include the processing of personal data in the future by the successors of the Foundation ‘Africa differently”
2.Confirms the authenticity of the data in the registration form.
3.Agree to receive- at the appropriate registration form e-mail account- messages and information sent on behalf of the Afrix.org.
Each user of Afrix.org has the right to update and delate data concering his profile. If you delate the data you lose the possibility of using the service, so far as these data are necessary to use the services provided by the service. In case of removal of the data which is necessary for user registrations on the webpage, user loses the possibility of using the webpage.
3.Rights and obligations of the Afrix.org users.
1. User by placing information on the webpage Afrix.org, consent to the use of these materials by other users for their personal use.
2. Afrix.org service has the right to free use and distribution, particularly the right to copy, publish, modify, and use of translation in different way, in any field of exploitation of all materials deliver to Afrix.org- even after the resignations of the user or after removal of User account by that service, except where specific provisions of the regulations provide in another way.
3. Afrix.org User is entitled to use the materials placed on the webpage only for personal use. Any other use of these materials is not acceptable- unless under proper authorization from the authorized person.
4. Each User is obligated to respect Polish law. In matters of issues not mentioned in Regulation apply Polish law. It is not allowed on Afrix.org to post:
§ pornographic materials
§ materials which violate copyright law
§ materials promoting fascism or Nazism
§materials that promote violence and hatred
§ materials that promote drug use
§ materials that offend religious symbols
§ files infected by viruses
§ materials that call for hatred on racial, religious or ethnic grounds
§Users or materials that offend others
§materials that are used to carry out political, religious or racist propaganda and materials which promote other websites
5. It is considered an illegal posting on webpage links:
§ for web pages which are prohibited by Polish law
§ for web pages that are similar to Afrix.org
§ for web pages which capture password for Afrix.org accounts
§ for web pages that are potentially dangerous and/or may contain viruses- any attempt to break this point will be reported to the police, and the profile will be blocked or removed.
6. You must not in any way exploit, copy or distribute data about other members contained in Afrix.org.
7. You cannot use Afrix.org as a distribution channel for promotional purposes or commercial ( eg: junk emails, spam etc. )
8. The webpage Afrix.org prohibites:
§ spamon the Afrix.org webpage
§ creating and sending links for material benefits or for stealing password or user profile or any other actions aimed against User
Proceedings in the above mentioned manner authorizes the Afrix.org administrator to remove the user profile.
9. Users assume full responsibility for any damage caused by unlawful conduct and the provisions of these regulations.
10. Duration of use is not limited in advance. User is not required to use service for any specified minimum.
11. Users by providing to other Users materials on Afrix.org gives the owner the non-exclusive, royalty-free license to use these materials and works in the following fields of operation:
§ public performance, exposure, display, reproduction, and broadcasting as well as the public takes place in such a way that everybody can have access to it in a place and time individually chosen by them;
§ permanent or temporary multiplication works in whole or in part, by any means and in any form, including the technique of printing, reprographic, magnetic recording and digital technology, in particular the introduction of memory, magnetic, optical or magneto-optical computers and other technical equipment .
12. Using the service is free of charge, unless it decides on the contrary, in the Annex to these Regulations, the Administrator Afrix.org.
4.Afrix.org Rights and Responsibilities
1)Afrix.org is not liable, in particular under civil, penal or administration law for the content, photos, video etc. published by the Users or any other actions which infringe the provisions if this Regulation.
2)Afrix.org shall undertake all the measures to ensure a constant access to the website. Afrix.org shall reserve the right to temporary suspension of the website for a significant reason, without prior notice.
3)Afrix.org is not liable for direct, indirect, incidental, special or consequential damages, loss or any other incidents caused by the Users arising out of the actions connected to the access, use or downloading materials posted on the Service and their exploitation. In particular, it is not liable for damages arising from the interruption in access to the Service, computer errors occurred for any reason.
4)Afrix.org shall not provide any guarantee for a correctness of the content posted in the Service and is not liable for the consequences of use of the content and information posted in Afrix.org.
5)Afrix.org is concerned about the quality, completeness and value of all the information posted in the Service. Afrix.org shall not provide guarantee for an accuracy of the content posted in the Service (texts, pictures and other files).
6)A User entitles Afrix.org to use, distribute, and in particular copy, publish, modify, translate or make any other use free of charge in an, in any field of exploitation, of all materials provided to Afrix.org by its Users, even when the User resigned or was removed from the Service, unless the provisions of particular services state otherwise.
7)The Administrator of Afrix.org shall have a full access to the User’s profile. He may use the information posted in the profile of the User if there are complaints on a User or when he is suspected to violate the Regulation.
8)In case of inveterate actions against the regulation or acting against polish law by a User, Afrix.org reserves the right to remove the profile of this User. The profile is removed irretrievably.
9)Afrix.org reserves the right to communicate with the User via e-mail in order to verify a status of the User’s profile or in other situations related to the functioning of the Service.
10)If the User’s actions threaten other Users and the administrators have applied all the means of prevention (warnings, blocks on the account), the Service shall reserve the right to remove the User’s profile or take the action, also a legal one against his/her activity.
11)Afrix.org has an exclusive right to determine the content of the Service, also the right to unilaterally remove at any time or modify the content and functions of the Service, deny the access for a User, cease running the Service or any of its services, transfer right to the Service or take any action permitted by the law in relation with the Service.
12)Afrix.org stipulates as well that it has a right to unilateral modification of the rules of using the Service and the services available in the Service, for any reason. In particular, it concerns the possibility of establishing a charge for using the services available.
13)Using the Service after modifications referred to in paragraphs 1 and 2 is tantamount to its approval.
5.Foundation “Africa Another Way” Property
1)Afrix.org Service and all the materials, information, texts, navigation solutions, choice and layout of the content, logotypes, graphic elements, interactive applications, audio and video files, compilations of materials and case studies are the property of Afrix.org Service, excluding these that are a separate property of other producers, broadcasters, and service providers. The same rules apply to all the materials that Afrix.org provide to its Users via electronic means, in particular e-mails.
2)Modify, copy, distribute, transmit, display, transfer, reprint, sublicense, compile the materials, referred to in point 1, also send and sell these materials is unacceptable, unless it is authorized by a competent body.
6.Safety
1)Safe log in:
We recommend that the User should pay attention to the website address where he logs in Afrix.org (www.afrix.org)
A password should be complicated and it should not contain any information related to the User. Otherwise a potential hacker will be able to discover the User’s password.
2)Profile Safety
In order to increase safety you are recommended to change password occasionally;
If a computer that you use to connect with Afrix.org is used by other people, we ask you to log out after leaving the stand.
3)Posing as a User or Administrator of Afrix.org (phishing):
All the information about competitions, bonuses, modifications on the Afrix.org website are transmitted via system messages or they are displayed on the home page. Afrix.org shall not send any private mails. If a User has got a private message containing such information, please forward it to the Administrator.
Afrix.org warns against the websites addresses very similar to the Afrix.org, for example: www.afrix.prv.pl. These are the websites created in order to wangle the password and hack the profile;
Posing as a User or Administrator of Afrix.org will be punished by removing the account without notice. In case of unremitting violation of the Regulation in this point, the profile will be removed. The profile will be removed irretrievably.
4)The base of the Afrix.org Users is registered at The Bureau of the Inspector General for the Protection of Personal Data.
7.Final regulations
1)The Regulation shall enter into force on 19 November 2009.
2)Afrix.org reserves the right to change the provisions of this Regulation at any time. Every change shall enter into force on its publication.
3)To all matters not settled in this Regulation, the provisions of polish law shall apply.
In case of any discrepancies in their interpretation, the Polish language version of the text shall prevail.
